2. Our services

DV Check provides driving licence verification and compliance services using the DVLA Access to Driver Data (ADD) service. Our services may include:

• Driving licence checks
• Driver licence monitoring
• Compliance reporting
• Driver records management
• Fleet compliance support
• Customer dashboards and reporting

3. Customer responsibilities

Customers agree to:

• Ensure they have lawful authority to request licence checks
• Obtain valid driver consent where required
• Keep login credentials secure
• Ensure submitted information is accurate
• Use the service only for lawful business purposes
• Comply with all applicable data protection legislation

Customers must immediately notify DV Check if they believe their account has been compromised.

4. Driver consent

The customer is responsible for obtaining and maintaining valid driver consent before requesting licence information through the DVLA ADD service. DV Check reserves the right to refuse or suspend access where appropriate consent cannot be demonstrated.

5. Use of DVLA data

Information supplied through the DVLA ADD service:

• Remains subject to DVLA terms
• Must only be used for authorised business purposes
• Must not be disclosed to unauthorised persons
• Must not be sold or reused for marketing

6. Customer accounts

Customers are responsible for:

• Maintaining accurate account information
• Protecting passwords
• Ensuring only authorised users access the account

DV Check may suspend accounts where misuse is suspected.

7. Fees and payment

Where applicable:

• Fees are payable in accordance with the agreed pricing schedule
• Invoices must be paid within the agreed payment terms
• Overdue accounts may result in suspension of services

Online payments are processed by secure third-party payment providers.

8. Availability

We aim to provide continuous availability but cannot guarantee uninterrupted service. Services may occasionally be unavailable because of maintenance, updates, DVLA system availability, or events beyond our reasonable control.

9. Accuracy

DV Check relies upon information supplied by the DVLA. While reasonable care is taken, DV Check cannot guarantee that information supplied by the DVLA is complete, current or free from error. Customers remain responsible for making employment and operational decisions.

10. Intellectual property

All software, reports, branding, documentation and website content remain the property of Axholme ETM Ltd unless otherwise agreed.

11. Data protection

Both parties agree to comply with UK GDPR, the Data Protection Act 2018 and applicable privacy legislation. Our Privacy Policy forms part of these Terms.

12. Limitation of liability

To the maximum extent permitted by law, DV Check shall not be liable for:

• Indirect losses
• Loss of profits
• Business interruption
• Decisions made solely on the basis of DVLA information
• Losses arising from incorrect information supplied by customers or third parties

Our total liability shall not exceed the fees paid by the customer during the previous twelve months. Nothing limits liability for death, personal injury caused by negligence, fraud or any liability that cannot legally be excluded.

13. Suspension and termination

DV Check may suspend or terminate accounts where:

• These Terms are breached
• Unlawful use is suspected
• Payment remains outstanding
• Required by law or the DVLA

14. Changes

We may amend these Terms from time to time. The latest version will always be published on this page.

15. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
